Trusts and the elderly

Growing older doesn't necessarily mean having more to worry about in terms of legal arrangements. With Challenor Gardiner's personal advice, preparations can be made right now which can save a lot of concern later on.

If you are worried that you many become mentally incapable of managing your affairs, talk to one of our solicitors about making a Lasting Power of Attorney. We have experts at the ready to advise and guide you through organising a trust, Power of Attorney and all related issues.

Setting up a trust fund

Trust funds can be as simple or as complex as you need them to be. Whether you want a trust set up to protect your home or other assets, save tax on inheritance or benefit your children or grandchildren, Challenor Gardiner Solicitors are here to advise.

Trusts are also great long term - a common example is a fund that permits the trustee to use the income, whilst preserving the capital for the next generation.

Lasting Power of Attorney

A Lasting Power of Attorney enables you to appoint someone now to act for you in the future, in the event that you become incapable of managing your own affairs.

There are two types:
  • The first covers finances
  • The second covers the decisions you will permit your Attorney to make about your care and welfare

Neglecting to appoint a Lasting Power of Attorney could mean that your loved one will have to wait to be appointed by the Public Guardian's Office before acting for you, which isn't what you want when things need to be done quickly.

Also many thanks for the efficient and sympathetic way in which you handled our business
